- Provide accurate contact details in your profile.

- Remain professional. Check for spelling and grammar.

The DONT's:

- No SPAM emails are allowed.

- One-liners in the body of your emails are not allowed. (ex: "I am looking for a property.")

- You are allowed to email the same listing once every TWO weeks.

Please familiarize yourself with BuzzTarget's Listing Policies (the "Listing Policies") prior to entering a property listing on the BuzzTarget website. All listings are subject to the Listing Policies.

1. Required Fields

All fields noted by an asterisk (*) on the add property page are required fields and must be completed with valid data pertaining to the property being listed ("Required Fields"). Property listings where data is missing or data entered in the Required Fields is deemed illogical will be removed from the site until valid content is entered in the Required Fields.

1. Address Fields
   All Address fields on BuzzTarget including Address, City, State and Zip Code are Required Fields. These fields are intended for listing the physical address or intersection of the property being listed. These fields are not for the listing of additional information about the property. Entering "Confidential", "Call Broker", "Withheld", or any other verbiage designed to withhold, hide, and/or conceal the physical address in the Address or City Name fields is strictly prohibited. BuzzTarget reserves the right to remove any and all property listings with non-address related or invalid information in any address specific field with or without contacting the listing broker.
2. Property Description
   Property descriptions are for the description of the property that is for sale or for lease only. The posting of contact name, phone number, fax number, company information or URL links for any contacts including those who are not BuzzTarget members is strictly prohibited in this section. This type of information in the Property Description field will be removed from the listing and the listing broker will receive an email informing them of the change. Habitual violations of this policy will result in BuzzTarget's removal of all of such Customer's active listings on the Service until all such content has been appropriately rectified.
3. Property Type
   Properties must be identified with the appropriate property type. Adding the same listings under multiple property types is prohibited. BuzzTarget allows each listing to associate with property types in order to improve exposure for the listing during searches. BuzzTarget reserves the right to change or remove property types deemed to be misleading.
4. Pricing
   A valid Sales Price in the Price Asking field for the listed property is required for all BuzzTarget Sale Listings and a valid rental rate for each space is required for all BuzzTarget Lease Listings. Confidential pricing is permitted on sale listings for Premium Members only. BuzzTarget reserves the right to remove all listings that are deemed to have invalid prices or rental rates including any listing with $0 listed in Lease Rate, Sales Price and Opinion of Value fields.

2. Listing Parameters

In order to maximize the features of the BuzzTarget service, Customers should note certain parameters in the listing process.

1. Commercial Property
   BuzzTarget is a web site for commercial real estate. Listing of single-family residences is prohibited on the BuzzTarget website, except if such residences have a residential income purpose (e.g. to purchase a residence whose customary use has been as a rental property), in which case such properties may be listed under the Residential Income category only. The listing of single family residential income property under all other categories is prohibited. Any listing deemed to be a non-income generating, single-family residence will be removed from the system during the listing approval process and an email will be sent to the Customer stating that the property has been identified as a single-family residential property.
2. Contact Information
   Premium Member’s Listings added to the BuzzTarget web site will receive Premium Member benefits if the Primary Contact referenced for that listing is a Premium Member within his or her Featured Listing Plan.
3. Duplicates
   Property Listings BuzzTarget prohibits the listing of a single property more than once on the web site at the same time. A duplicate is defined as the same physical property listed under more than one property ID. BuzzTarget reserves the right to remove any and all properties that are determined to be duplicates with or without contacting the listing broker. Customers may, however, list a property for sale and for lease at the same time. Space Listings BuzzTarget prohibits the listing of the same space more than once on the web site at the same time. A space listing is defined as a single suite or unit of space listed for lease. Total space available in a building cannot exceed the total square footage of the building. BuzzTarget reserves the right to combine duplicate space listings into a single listing or to remove the listing from the system with or without contacting the listing broker.
4. Listing Quantity, Submission, and Display
   Members may list an unlimited number of listings on BuzzTarget.com. Premium Member subscription provides Premium exposure for the number of listings paid for in the Featured Listing Plan. Premium Listers must list all Featured listings in accordance with BuzzTarget's Terms and Conditions. Standard Listings submitted to BuzzTarget will only be available to Premium Listers and Premium Searchers searching for property on BuzzTarget and will not be fully displayed in search results for other Basic Members to view.
5. Use of Photographs
   Building photographs posted, attached, or affixed to listings must be actual photographs of the building being listed. All such photographs must be either (a) the property of the listing broker or (b) the listing broker must have received all necessary rights and authorizations, including from the photographer and/or copyright owner of any photographs, to publish such photographs on the Customer's website or on BuzzTarget's website for the purpose of advertising the subject property. Photographs uploaded that are not directly related to the building or property being listed, including brokerage company logos, may be removed at the discretion of BuzzTarget.
6. Listing Review
   All listings entered on BuzzTarget may be subject to review by BuzzTarget company personnel ("Listing Review") prior to becoming available for full viewing online. BuzzTarget reserves the right, but not the obligation, to review any listing entered by Customer on BuzzTarget. Although Customer's listings may be subject to Listing Review, Customer remains solely responsible for abiding by the Listing Policies and BuzzTarget's Terms and Conditions. The Listing Policies prohibit Customer from entering any listing that infringes upon the intellectual property rights of any party, or that otherwise violates BuzzTarget's Terms and Conditions. By entering listings on BuzzTarget, Customer warrants and represents that Customer owns or otherwise controls all of the rights to such content including, without limitation, all the rights necessary for Customer to provide, post, upload, input or submit such content. Customer acknowledges that BuzzTarget cannot police or control all of the content provided by Customer(s) that is made available on BuzzTarget. Listings that violate any of the Listing Policies stated herein will not receive Listing Review approval for active posting on BuzzTarget until the issue in question has been addressed. When conducting Listing Review, new listings added to BuzzTarget are examined to determine whether such listings are in compliance with the Listing Policies. In the event Listing Review determines a listing violates Listing Policies (including but not limited to containing inaccurate or incomplete information), Listing Review will send an email message to the Customer about such listing, clearly stating how such proposed listing does not conform to established Listing Policies and offering solutions on how to rectify the deficiency. After the Customer receives notice from Listing Review, the Customer will be given a reasonable amount of time (routinely, 48 hours) to respond. It is then the sole responsibility of the Customer to review the communication from Listing Review, revise the listing as appropriate, and resubmit the corrected listing. Once the appropriate revision has been made, and Listing Review determines the listing is compliant with Listing Policies, the listing will be made available for full viewing on the site. However, if the Customer fails to respond to the communication from Listing Review, BuzzTarget in its sole discretion reserves the right to remove any and all content that continues to violate the Listing Policies, including disallowing listings from the Service.

3. Prohibited Conduct

Customers are advised to refrain from engaging in the conduct specified in this section, as it is not permitted on the BuzzTarget Service.

1. "Billboard" Listings
   Listings on BuzzTarget are for properties that are currently offered for Sale or Lease. It is not permitted to post listings on the Service that have already been sold or are no longer on the market, i.e. posting listings on the Service for marketing or advertising purposes ("Billboard Listings"). All listings for properties already sold or off-market will be removed.
2. Keyword Manipulation
   BuzzTarget offers the ability to search for properties on key words. This is designed to enable searchers to narrow their criteria based on specific requirements. Keyword manipulation is unfair to searchers by returning listings that clearly do not meet their criteria. Keywords identified in the property name, property description, location description or property highlights field that are clearly not relevant to the property being marketed will be removed by Listing Review. Habitual abuse of this policy by a Customer may, at the sole discretion of BuzzTarget, lead to the removal of all of that Customer's active listings from the web site and suspension of that Customer's ability to list properties on the Service.
3. Offensive Language
   Use of profanity or vulgar language in any section of the BuzzTarget database is strictly prohibited. This includes the use of language that is generally considered obscene, profane, sexual, hateful, or racist in nature. Listing or user information that includes profane language will be removed from the Service immediately. Customers posting such language to the BuzzTarget web site may be subject to disciplinary action, including indefinite suspension of a Customer's account, temporary suspension or a formal warning.

Private Lists:

Here are some examples of private lists that are okay, and lists that are not okay to use in BuzzTarget. This is just a guideline that we compiled from. Your situation may be different, so always refer to our terms of use for detailed requirements.

Your list is ok if:

1. People who have opted in to your list on your own website
2. People who have opted in to receive emails from you offline
3. People who opted in to receive emails from you at a co-registration site
4. You're sending on behalf of your customer, and they comply with the above.
5. People who purchased one of your products, or attended an event, and gave you their email address so they could receive updates from you.
6. Your internal employee list (such as for company notices)
7. Press releases sent to reporters who signed up at your website

Your list is not ok if:

1. Lists that you purchased from a 3rd party (even if it's "opt-in")
2. Lists that you are renting from someone else
3. Lexis-Nexis, Real Estate MLS databases, Advertising Redbooks, AdBase lists, D&B, Experian
4. Lists from a local Chamber of Commerce or local club or organization.
5. Do NOT export your entire email address book into BuzzTarget. There are email addresses in your address book that you probably don’t know are in there, like: tech support contacts from companies you’ve requested help from and companies who’ve sent you email order receipts, etc
6. Emails that you "scraped" (either manually or automatically) from other websites
7. Recipients whose emails you collected without their permission, but you think they could really use your product or service, and you think they'd really want to hear from you.
8. Members of a group/organization who never asked for your emails (even if you're a member of the group)
9. Unsolicited press releases to reporters
10. Lists of customers who dropped their business cards in a fishbowl, but they had no idea they were going to receive emails (because you didn't say that on the fishbowl).
11. Lists of registered voters in your district obtained from your local government.

The submission of information to, and use of, the real estate information services (collectively, the "Service") available through the BuzzTarget website (located at http://www.BuzzTarget.com) is subject to the following terms and conditions (the "Terms and Conditions" or the "Agreement"). BY SUBMITTING INFORMATION to, or accessing information from, the Service, YOU, the end user customer ("Customer") AGREE TO THE FOLLOWING TERMS AND CONDITIONS. These Terms and Conditions are a legal agreement between you and BuzzTarget, LLC. ("BuzzTarget" or the "Company"). You also agree to the BuzzTarget Listing Policy (the "Listing Policies") and Privacy Policy, both of which are available by hyperlink on our site.

If you do not agree to these Terms and Conditions and to the Listing Policies and Privacy Policy, do not submit information to, or access information from, the Service. All questions concerning this Agreement should be directed to: BuzzTarget, Inc., 505 West 37th Street, Ste 3802, New York, NY 10018. BuzzTarget may update these terms and conditions at any time and without notice. The latest version of the terms and conditions is available on the BuzzTarget website.

GENERAL PROVISIONS

1. Membership Privileges: Membership privileges are granted by BuzzTarget to individuals exclusively and are granted specifically to the subscribing registered member only. No employee, independent contractor, agent, or affiliate of a competing real estate information service is permitted to access any of the Password Protected Areas of the BuzzTarget website without express written permission from BuzzTarget. Membership rights cannot be assigned, sublicensed, distributed, shared, viewed, accessed, or otherwise transferred to anyone other than the registered member without the express written permission of BuzzTarget. BuzzTarget requires that each registered user maintain a valid email address and a password, which shall be utilized for logging on to the BuzzTarget system. Members are not permitted to share their individual logon information with others. BuzzTarget has the right to refuse service to any member, individual, organization, or firm (and all members associated or affiliated with said organization or firm) that refuses to abide by the terms and conditions herein, refuses to abide by the Listing Policies as posted and displayed on the BuzzTarget website, or abuses their rights related to the BuzzTarget service. Upon registration, which is free, Customer becomes a Free or Basic Member. A Free Member may search the BuzzTarget listings Service, and will receive all of the results matching the Customer's designated search parameters. A Free Member may also list as well as send and receive email blasts. Some limitations may apply.
   
   BuzzTarget utilizes email as a vital and primary communication channel with customers. As a registered user, Customers hereby acknowledge and grant BuzzTarget the permission to communicate with customers via email (as well as other communication channel such as phone and fax) for any purposes BuzzTarget determines to be relevant including, but not limited to, system messages, product updates, service announcements and other marketing messages. BuzzTarget will use best efforts to honor Customer's request to opt out of marketing messages, but under no circumstances will BuzzTarget have any liability for sending any email to its registered users/customers. By becoming a member of BuzzTarget, LLC., you acknowledge and agree that BuzzTarget, LLC. may record telephone and other electronic communications it has with you for BuzzTarget, LLC.'s internal business purposes, including but not limited to training and quality assurance purposes.
2. Submission and Administration of Listings: Customer agrees not to submit any property descriptions, photographs, financial, contact or other information contained in each Property's data to BuzzTarget unless the Customer has received all necessary rights and authorizations, including from the photographer and/or copyright owner of any photographs, to publish and advertise the Property on the Customer's website or on BuzzTarget's website. Specifically, Customer will not submit a photograph if Customer received the photograph from a third party information provider under the terms of a license that does not allow posting of such photograph on the BuzzTarget website. The Company may, in its sole discretion but without any obligation to search for such, remove Properties that are alleged to have been submitted in violation of this provision. In addition, the Company may require additional evidence of compliance with this provision from Customers who are alleged to have submitted Properties or other information in violation of this Agreement. The Company will, in its sole discretion, terminate the accounts of, and refuse service to, any Customer who repeatedly or knowingly violates this Agreement. Customer agrees to maintain accurate contact information (specifically, a valid phone number and email address) in order to submit and maintain active property listings on the BuzzTarget website. Customer shall not use robot, spider or other automated service to submit listings on the BuzzTarget website. Additionally, the Customer agrees to allow submitted Property listing(s), or any part therein, to be searched, displayed, accessed, downloaded, copied, and otherwise referred to by users of the Customer's website, the BuzzTarget website and other BuzzTarget partner websites. The Company shall have the sole authority to choose the manner in which any Property will be searched, displayed, accessed, downloaded, copied, and otherwise used on the BuzzTarget website and Company shall have the right to modify the property listing in the exercise of its rights under this Agreement. The Customer (a) represents and warrants that all Properties and associated information provided by the Customer will be accurate; (b) agrees not to post a property on the public BuzzTarget marketplace under a name other than the named licensed real estate agents that have been engaged by the property owner to market the property under the terms of a duly executed listing agreement with the owner; (c) agrees to administer the Properties provided by the Customer and maintain their accuracy at all times. The Company reserves, in a manner consistent with reasonable commercial business practices, the right to remove all or any part of the Properties posted on the Customer's website or on the BuzzTarget website. The Company accepts no responsibility for checking the accuracy of reports or data files submitted by the Customer. While the Company shall take all reasonable efforts for data backup and business resumption, the Customer will be solely responsible for retaining back-up copies of all information, photographs and other materials it provides to BuzzTarget. BuzzTarget may add digital watermarks to certain parts of your property listing, including photographs. We add these digital watermarks to protect against the copying or further distribution of your photographs without your permission.
3. Email Blasts: All Email blasts submitted through the Service are subject to Editorial Review for completeness and SPAM. A BuzzTarget member is only allowed to send the same email blast to BuzzTarget members once every two weeks. If an email blast is rejected by our Editorial Staff, the member will be notified via email of the reason and will have an opportunity to resolve any issue raised by our staff.
4. Use of Information: Customer agrees to treat all information obtained from the Service, including listings, member directory, historical transaction information ("Property Comps"), and any information otherwise made available to Customer in the Service (individually and collectively, the "Content") as proprietary to BuzzTarget. Customer agrees that Content reserved for members will be maintained as confidential and shall be protected as a trade secret of BuzzTarget. BuzzTarget does not ensure the accuracy of, endorse or recommend any Content and Customer uses such Content at the Customer's own risk. Customer may access the Content solely to obtain initial information from which further evaluation and investigation may commence.
   
   Email addresses that Customer uploads to Private Contacts are for Customer's use only; BuzzTarget agrees not to use Customer's Private Contact List.
   
   Customer shall limit access to and use of active property listings and member directory information to personal and internal use, and shall not use any information obtained from the Service for further distribution, publication, public display, or preparation of derivative works or facilitate any of these activities in any way. Customer shall not use or reproduce any Content that is obtained from the Service, or that is otherwise made available to Customer in the Service, for or in connection with any other listing service or device. Customer further shall not use the Service in any other manner for or in connection with any other listing service or device. Customer shall not use the BuzzTarget Service as part of any effort to compete with BuzzTarget, including without limitation using the BuzzTarget Service to provide, alone or in combination with any other product or service, any database services to any third party or any use that causes a reduction or loss from an existing or potential BuzzTarget customer, nor shall Customer remove, erase, or tamper with any copyright or other proprietary notice printed or stamped on, affixed to, or encoded or recorded in the BuzzTarget Service. Customer shall not use any robot, spider or other automated process to submit listings, monitor, data mine or copy BuzzTarget products, services or information; decompile, decode or reverse engineer BuzzTarget software; or use BuzzTarget products or services in an unlawful manner, such as for offensive, abusive, tortious, libelous, defamatory or other illegal purposes. Customers violating these specific terms, specifically those customers searching the Service in an abusive or excessive manner, by automated or manual means, shall be subject to immediate termination of their membership.
5. Passwords/Logins: Members, registered users and Customers are required to maintain the confidentiality of all logins and passwords. You are responsible for the activities that occur under your account, login or password. BuzzTarget is not responsible for any loss or damage arising from your failure to maintain the confidentiality of your account, logon information or password and/or failure to comply with the terms and conditions set forth in the Membership Privileges, Use of Information or Ownership and License Grant sections of this agreement that relate to confidentiality of account, logon or password information.
6. Payment Terms: Customer agrees to pay for all products ordered through the BuzzTarget website or via the BuzzTarget sales team using the payment method indicated, and provides BuzzTarget express authorization to charge said fees to the Customer's payment provider at time of purchase or renewal. Fees owed depend on the specific type and quantity of BuzzTarget products, services, information, or deliverables (collectively "Deliverables") ordered. Payment of fees shall not be contingent on any events other than the delivery of the ordered Deliverables. Any attorney fees, court costs, or other costs incurred in collection of delinquent undisputed amounts shall be the responsibility of and paid for by Customer. If payment is not current, BuzzTarget may immediately cease to provide any and all Deliverables to the customer. If you are not satisfied with the service, you may cancel your subscription at any time. The fees paid for monthly subscriptions are non-refundable, regardless of whether the subscription is terminated prior to the end of the then-current monthly billing period. Discounts received via a product bundle are subject to removal when product(s) in bundle are canceled. Prepaid fees will be refunded based on the number of months remaining on the contract period, beginning with the month following receipt of written cancellation, but may be subject to adjustment according to current monthly product pricing and subject to adjustment for any incentives or discounts provided for said prepayment. No partial month refunds will be provided.
   
   Subscriptions will automatically renew using the Customer's current credit card account number unless Customer cancels their subscription on the BuzzTarget Website three (3) days prior to the renewal date to cancel such subscription. All cancellation requests will be processed within five (5) business days. Once the cancellation is processed, a confirmation email will be sent via the customer's email account on record with BuzzTarget. If Customer has a question about a cancellation, Customer should contact BuzzTarget Client Services at support@buzztarget.com or at 347-946-2899. The Company reserves the right to change its fees or billing methods at any time. The Company will provide timely notice to the affected Customers of any such changes.
   
   It is the Customer's responsibility to promptly provide the Company with any contact or billing information changes or updates (including phone number, email address, credit card numbers, etc.). Account updates should be made online via the "My Subscriptions" tab within the "My Account" section, once Customer has logged into www.BuzzTarget.com. BuzzTarget does not validate all credit card information required by the Customer's payment provider to secure payment.
   
   The Customer must notify BuzzTarget about any billing problems or discrepancies within 90 days after charges first appear on their Account statement. If it is not brought to BuzzTarget's attention within 90 days, Customer agrees to waive their right to dispute such problems or discrepancies.
7. Premium Subscriptions: BuzzTarget offers five distinct paid subscription membership products to its active members. More details of the subscriptions can be found on our Pricing Page. A Customer who purchases a Premium subscription is a "Premium User." Premium Subscription privileges are granted by BuzzTarget to individuals exclusively and are granted specifically to the subscribing Premium User only. Premium Subscription rights cannot be assigned, sublicensed, distributed, shared, viewed, accessed, or otherwise transferred to anyone other than the subscribing Premium User without the express written permission of BuzzTarget. Premium Subscription privileges are subject to change from time to time and may be subject to property listing, property searching, email blast services and private contact list size. Higher Featured Listing Plans are available for purchase by calling (347) 946-2899 or emailing support@buzztarget.com. Customer acknowledges that BuzzTarget (in addition to its other remedies) can cancel and prohibit Premium Subscription privileges to any individual, organization, or group that does not abide by the terms and conditions set forth herein and/or can refuse any or all membership privileges. BuzzTarget also has the right to refuse service to any customer or company that has delinquent charges that remain unpaid and to impose additional charges to reactivate Premium Subscription or other membership privileges. Premium Subscriptions continue to renew at the prevailing level regardless of Customer's listing or searching activity on BuzzTarget.com. Premium Subscriptions will automatically renew to the credit card number provided for initial payment unless the Customer cancels their subscription on the BuzzTarget Website three (3) days prior to the renewal date to cancel such subscription. The Company reserves the right to change its fees, payment frequency, or billing methods at any time. The Company will provide timely notice of any such changes.
   
   After adding a listing at our Free pricing tier, the Customer will have the option to change current membership level to a Premium Member with a Featured Listing Plan which will provide the option of Featured exposure for the listing. For all Plan changes submitted online, the Customer will be charged a prorated change plan fee for the remaining days in current billing cycle, and Customer's subscription rate will be adjusted commencing with the next bill date. Premium Users may change current membership level to a lower Plan by clicking to "My Subscription" under "My Account". Service will downgrade the earliest created Featured Listing(s). No partial month refunds will be provided.
8. Unsolicited Commercial Email (Spam): BuzzTarget prohibits the use of our system or its tools to generate or send unsolicited commercial email (spam). Customers may not use the Email The Broker, Email a Friend service, or other email services that BuzzTarget offers to send spam (i.e. unsolicited commercial email) or otherwise send content that would violate these Terms and Conditions. By using BuzzTarget, Customer agrees to send email only to those who have given Customer consent or with whom Customer has an established business relationship. BuzzTarget has the right to revoke the privileges of any customer or company that breaches these terms.
9. Termination: BuzzTarget reserves the right to terminate a Customer's membership at any time without prior notice with or without cause. Cause for termination includes, but is not limited to, breaches or violations of the Terms and Conditions, requests by law enforcement, fraudulent or illegal activity by you, discontinuance or material modification of BuzzTarget services, nonpayment of fees owed by you in connection with BuzzTarget services, account inactivity or technical or security issues. Upon termination, BuzzTarget shall have no obligation to maintain or forward any content in your account.
10. Ownership and License Grant: BuzzTarget retains all rights (including Intellectual Property Rights as defined below), title and interest in the BuzzTarget Website technology and brochures and all underlying technology and data including any enhancements and improvements thereto as a result of providing the Deliverables hereunder. Customer will not and will not allow others to: reverse engineer, decompile, disassemble, merge, copy, use, disclose, sell or transfer the underlying source code or structure or sequence of BuzzTarget's technology or delete or alter author attributes or copyright notices. Customer shall use the BuzzTarget system solely for their own use and shall not allow others to use the BuzzTarget system under or through that Customer's login ID/email and password.
    
    Intellectual Property Rights means all intellectual property rights (throughout the universe, in all media, now existing or created in the future, for all versions and elements, in all languages, and for the entire duration of such rights) arising under statutory or common law, contract, or otherwise, and whether or not perfected, including without limitation, (a) all rights associated with works of authorship including without limitation copyrights, moral rights, copyright applications, copyright registrations, synchronization rights; (b) rights associated with trademarks, service marks, trade names, logos, trade dress, and the applications for registration and registrations of trademarks and service marks; (c) rights relating to the protection of trade secrets and confidential information; (d) rights analogous to those set forth in this definition and any and all other proprietary rights relating to intangible property; and (e) divisions, continuations, renewals, reissues, and extensions of the foregoing (as and to the extent applicable) now existing, later filed, issued, or acquired.

Limitation of Liability and Indemnification: IN NO EVENT SHALL BUZZTARGET BE LIABLE FOR ANY INDIRECT, EXEMPLARY, PUNITIVE, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, LOSS OF BUSINESS, INTERRUPTION OF BUSINESS, LOSS OF GOODWILL OR BUSINESS REPUTATION, OTHER INTANGIBLE LOSS, INACCURACIES, ERRORS OR OMISSIONS IN THE INFORMATION, PRODUCTS OR SERVICES PROVIDED, RELIANCE BY THE CUSTOMER ON THE COMPLETENESS OR ACCURACY OF INFORMATION, PRODUCTS OR SERVICES, LOSS OF USE OF DATA, LOSS OF DATA, COMPUTER VIRUSES, COMPUTER CORRUPTION, DELETION OR CORRUPTION OF CONTENT OR DATA MAINTAINED OR TRANSMITTED THROUGH THE USE OF BUZZTARGET’S SERVICES OR CUSTOMER'S FAILURE TO KEEP CUSTOMER'S LOGIN AND/OR PASSWORD SECURE AND CONFIDENT) ARISING OUT OF THIS AGREEMENT. Customer's exclusive remedy, and BuzzTarget's entire liability under this Agreement shall be a refund to Customer of the fees paid to BuzzTarget hereunder, and in no event will BuzzTarget's liability for any reason exceed such fee. BuzzTarget (and its officers, directors, employees and agents) shall not be liable for any damages whatsoever arising from Customer's use of the Deliverables, and Customer shall indemnify BuzzTarget (and BuzzTarget's officers, directors, employees and agents), and hold each of them harmless from and against any and all costs, damages or losses by any of them (including, without limitation, reasonable attorneys' fees) as a result of a claim by any person other than Customer arising from Customer's use or application of the Services or the Deliverables. Some jurisdictions do not allow the exclusion of liability for certain damages. As a result, some of the exclusions above may not apply to you.

BUZZTARGET MAKES NO PROMISES, REPRESENTATION OR WARRANTIES, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, WITH RESPECT TO THE LISTINGS, SERVICE, SALES COMP INFORMATION, PROPERTY FACTS INFORMATIOINCLUDING THEIR ACCURACY, OPERATION, CONFORMITY TO ANY REPRESENTATION OR DESCRIPTION, OR THE EXISTENCE OF ANY LATENT OR PATENT DEFECTS, AND BUZZTARGET SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, QUIET ENJOYMENT, WORKMANLIKE EFFORT, NONINFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE, WARRANTIES RELATING TO ENCUMBERANCES OR LIENS, AND, UNDER THE LAW OF THE UNITED STATES, THE IMPLIED CONDITIONS OF SATISFACTORY QUALITY AND ACCEPTANCE AS WELL AS ANY LOCAL JURISDICTIONAL ANALOGUES TO THE ABOVE AND OTHER IMPLIED OR STATUTORY WARRANTIES. BUZZTARGET MAKES NO PROMISES, REPRESENTATIONS OR WARRANTIES THAT ACCESS TO BUZZTARGET'S SERVICES WILL BE UNINTERRUPTED OR SECURE. ANY MATERIAL DOWNLOADED FROM BUZZTARGET'S WEBSITE , INCLUDING LISTINGS, SERVICE, PROPERTY COMPS INFORMATION IS ACCESSED AT CUSTOMER'S OWN DISCRETION AND RISK, AND CUSTOMER WAIVES ALL CLAIMS AND CAUSES OF ACTION RELATING TO ANY DAMAGE TO CUSTOMER'S COMPUTER SYSTEM, INTERNET ACCESS, DOWNLOAD OR DISPLAY DEVICE OR LOSS OR CORRUPTION OF DATA THAT RESULTS FROM SUCH DOWNLOADS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM BUZZTARGET OR ITS SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS AND CONDITIONS. While Google does not doubt the accuracy of the maps and/or directions, we have not verified the information and make no guarantees, warranties or representations about the maps and/or directions. It is your responsibility to independently confirm the accuracy and completeness of any map and/or set of directions. Customer assumes all risk of use. Neither BuzzTarget nor its partners or suppliers assume any responsibility for loss, damage or delay caused by Customer's use of and/or reliance on Customer's use of BuzzTarget's information, products or services.
14. Links to Third Party Sites: This website may contain hyperlinks to other websites operated by parties other than BuzzTarget, Inc. and its subsidiaries which are beyond BuzzTarget's control. Parties other than BuzzTarget may provide services or sell product lines on this site that take you outside of our service. This includes links from advertisers, sponsors, and content partners that may use BuzzTarget's logo(s) as part of a co-branding relationship. For example, if you click on a banner advertisement the click may take you off the BuzzTarget site. BuzzTarget does not control, is not responsible for examining or evaluating, and does not warrant the offerings of, any of these businesses or individuals or the content of their websites. BuzzTarget does not assume any liability for the actions, product, and content of all of these and any other third parties. Other Rights of BuzzTarget, Inc.: Customer agrees that BuzzTarget shall have the right to use Listings and other information submitted to it for any purpose, including without limitation for publication of all or part of such Listing on the Internet for unrestricted use by BuzzTarget customers and partners. BuzzTarget shall have sole authority to choose the manner in which any Listing will be received, displayed and used by the Service, and reserves the right to remove all or any part of a Listing or refuse Services to anyone at any time in its sole discretion. BuzzTarget shall have no obligation to (i) resolve disputes among users of the Service; or (ii) monitor or verify the accuracy or proper use of the Listings. BuzzTarget reserves the right to modify or change any and all terms and conditions at any time. The most current copy of these terms and conditions will be posted and available for review on BuzzTarget's corporate website, located at http://www.buzztarget.com.
16. Copyright Complaints: If you believe that your work has been copied onto BuzzTarget in a way that constitutes copyright infringement, please provide BuzzTarget's copyright agent the written information specified below. Please note that this procedure is exclusively for notifying BuzzTarget that your copyrighted material has been infringed.
    
    - An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
    - A description of the copyrighted work that you claim has been infringed upon;
    - A description of where the material that you claim is infringing is located on BuzzTarget, with identifying information for the listing, if applicable;
    - Your address, telephone number, and e-mail address;
    - A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

17. Brokers and Agents: Any Customer who identifies himself or herself as a broker or agent on the BuzzTarget website member registration form or otherwise purports to be a broker on BuzzTarget hereby represents and warrants that Customer is validly licensed as a broker and is in compliance with applicable broker requirements in all jurisdictions in which Customer is required to be licensed. The Company may, in its sole discretion, but without any obligation to verify the licensure of such individual as a broker or agent, remove from the list of brokers any Customer whom the Company believes is not a licensed broker or agent in any applicable jurisdiction. The Company may, in its sole discretion, terminate the accounts of, and refuse services to, any Customer who repeatedly or knowingly misrepresents its licensed broker or agent status or upon notification by any state agency or similar governmental authority that such Customer is not a licensed broker. BuzzTarget does not and shall not have any obligation to independently verify the licensure of individuals identified as brokers and agents on the website. It is your responsibility to confirm the licensed status of any brokers listed on the BuzzTarget website.
18. Governing Law: This Agreement, and the Deliverables provided by BuzzTarget, shall be governed by the laws of the State of New York, without reference to conflict of laws principles. The parties hereby consent to the exclusive jurisdiction and venue of the State and Federal courts of Manhattan County, New York for the adjudication of any disputes or claims arising out of and/or related to this Agreement. If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of this Agreement, which shall remain in full force and effect.
19. Assignment: This Agreement shall be binding upon and shall inure to the benefit of the parties and their respective successors and permitted assigns. The rights under this Agreement or any license granted hereunder may not be assigned, sublicensed or otherwise transferred by Customer without the prior written consent of BuzzTarget, which retains the right to withhold consent in its sole discretion.
20. Waiver and Severability: The failure of BuzzTarget to exercise or enforce a legal right or remedy contained in the Terms and Conditions does not constitute a waiver of any such right or remedy. No waiver of any right, term or provision of the Terms and Conditions is deemed a waiver of any other right, term or provision. If a court of competent jurisdiction finds any provision of the Terms and Conditions to be invalid, Customer agrees that the remaining terms and provisions remain in full force and effect.
21. Notices: All notices to Company must be in writing and must be sent registered mail, certified mail, or overnight mail with a return receipt requested to Chief Operating Officer at BuzzTarget.
22. Entire Agreement: The terms and conditions of this Agreement constitute the entire agreement between the parties and supersede all previous agreements and understanding, whether oral or written, between the parties hereto with respect to the subject matter of this Agreement.

BuzzTarget.com collects certain information from and about its users in the following manner.

Information You Provide to Us: When you register to use BuzzTarget on a free or other basis, communicate with customer service, or send us an email, you provide us with information that we collect. Such information may include your IP address, name, physical address, email address, phone number, cell phone number, credit card information, and other information such as gender, occupation and other demographic information. By providing us with this information, you consent to your information being collected, used, disclosed and stored by us in accordance with this Privacy Policy.
2. Listing and Email Information: When you upload or create an email distribution list, create a listing or put together an Email Blast with BuzzTarget, we have access to the data on your list and the information in your campaign.
3. Other Information We Receive and Store: When you register to use BuzzTarget, we store "cookies," which are strings of code, on your computer. We also use electronic images known as Web beacons. With those cookies, we are aware of and collect information concerning when you visit our Website, when you use BuzzTarget, your browser type and version, your operating system and platform and other similar information. With Web beacons, we can determine when you open email we send you, and collect other data. You may turn off all cookies that have been placed on your computer by following the instructions on your browser on how to block cookies that have been placed on your computer. However, if you block our cookies it will be more difficult, and maybe impossible, to use the Services.
4. Tracking Our Emails to Our Customers: When we send emails to our own registered BuzzTarget customers, we'll sometimes track who opened the emails and who went so far as to click on any of the hyperlinks. We do this to measure the performance of our Email Blasts, and to improve our offerings to specific customer segments.
5. Reports: Our Members who receive Reports, can also determine who has opened or not opened emails or clicked on links. That and all other tracking information available to our Members is also available to us and we may collect and review that information.
6. Information From Other Sources: We may obtain additional information about you by using your email address, or other information, to directly, or through one or more services, search over the internet, or elsewhere. We thereby obtain information that appears to be related to such email address or other information, such as a name, age and participation in social media websites, (such information being referred to herein as "Supplemental Member Information").

3. Use and Disclosure of Your Personal Information

We will use and disclose your Personal Information only as follows:

1. To promote use, including continued use, of our Services. For example, if you leave your personal information when you visit our Website and do not sign up for any of the Services, we may send you one or more emails asking whether you wish to sign up. If you use any of our Services, and may benefit from using one or more other Services we offer, we may send you an email telling you about the other Service or Services.
2. To bill and collect sums owed to us. Uses for this purpose include sending you emails, invoices, receipts and notices of delinquency, to alert you if we need a different credit card number, and to otherwise try to collect money owed. We use third parties to handle secure credit card transaction processing and send billing information to such third parties, who maintain all information in confidence, to process your orders and credit card payments. 3. To send you System Alert Messages to let you know about temporary or permanent changes to our Services including planned outages, new features offered, version updates, point releases, major releases, abuse warnings, changes to our Privacy Policy and possibly other documents and agreements.

For example, in this regard, although it's the Member's responsibility to make sure that the email address of anyone who opts out of receiving Emails from that Member is removed from all of that Member's Distribution Lists, we try to make that happen automatically.

7. To meet legal requirements such as complying with court orders and valid subpoenas.
8. To provide information received hereunder to representatives and advisors such as attorneys and accountants to help us comply with legal and other requirements.

To support and improve the Services we offer including adding features and providing benchmarking and other comparison information regarding, for example, the relative success of a Members' Email Blasts and Listings compared to other Listing and Email Blast companies in the same or different industries. Benchmarking and similar information is derived from aggregating and analyzing data.
11. To communicate with you concerning your account for an informational, as opposed to promotional, purpose.
12. To transfer your information in the event of the sale of substantially all of the assets of our business to a third-party or in the event of a merger, consolidation or acquisition. However, in such event, any acquirer will be subject to our obligations under this Privacy Policy.
13. To send you informational and promotional materials that you elect ("opt-in") to receive.

4. Your Distribution Lists

Your recipient lists are stored on a secure BuzzTarget server. We do not, under any circumstances, steal your lists, contact people on your lists, market to people on your lists, sell your lists, or share your lists with any other party, except as required by law or, regarding contacting, except in response to a complaint or other communication directly from an individual on one of your lists. Only carefully selected, authorized personnel have access to view Distribution Lists. We do not hold your lists hostage. We do not make it difficult for you to reclaim them. You may export (download) your lists from BuzzTarget at any time so long as we have a copy. We will use and disclose the information in your Distribution Lists only for one or more of the following purposes:

1. To help enforce compliance with our Terms of Use and applicable law including, but not limited to, helping to create white lists and black lists, to develop and test algorithms, heuristics and other methods and tools for detecting violations, and to apply those methods and tools.

5. Safeguarding Your Information

To protect your information, our credit card processing vendor uses the latest 128-bit Secure Socket Layer (SSL) technology for secure transactions. In addition, our vendor is certified as compliant with card association security initiatives, such as the Visa Cardholder Information Security and Compliance (CISP), MasterCard® (SDP), and Discovery Information Security and Compliance (DISC).

BuzzTarget accounts require a username and password to sign in. When you're finished using BuzzTarget, please click the "Sign Out" link in the top right corner of your screen, to prevent someone from using your computer to access your account. You must keep your username and password secure and not disclose it to a third party.

Due to the sensitive nature of your Distribution Lists, we do not re-send forgotten passwords. Users must follow online instructions to reset their passwords if they forget them.

Account passwords are encrypted. We cannot see your passwords. We can only reset them.

6. CHANGES TO THIS STATEMENT

BuzzTarget.com has the discretion to occasionally update this privacy statement. When we do, we will also revise the “updated” date at the top of this Privacy page.
